What Is the Abortion Pill?

The FDA approved "abortion pill" generally refers to a medical abortion method that involves taking two different medications to terminate an early pregnancy. The first medication blocks the hormone progesterone, which is necessary for pregnancy to continue. Without progesterone, the lining of the uterus breaks down, and the pregnancy cannot continue. The second medication is taken 24 to 48 hours later. It causes the uterus to contract and expel the pregnancy through the vagina (1).

Abortion is legal in Virginia, but it is subject to some restrictions. The following policies are currently in effect (2):

Abortion is prohibited in the third trimester, except when continuation of the pregnancy is likely to result in the death of the woman or substantially impair her physical or mental health, as certified by physicians.

State Medicaide coverage of abortion is limited and only available in specific circumstances, such as when the pregnancy endangers the life of the individual or results from rape or incest.

Qualified health care professionals, including certain advanced practice clinicians, are permitted by state law to provide abortion care - not just physicians.

Why Medical Confirmation Matters First

• How far along the pregnancy is
• Whether the pregnancy is in the uterus

Second Trimester:

Under § 18.2-73:

• Abortion is still legal during the second trimester.
• However, only a licensed physician can perform it.
• It must be done in a licensed hospital.

Third Trimester:

Under § 18.2-74: 

• Elective third-trimester abortions are not legal in Virginia.
• Third-trimester abortions are only permitted in limited medical circumstances that meet the statutory requirements.
